POGOH is a public bike-sharing program operated by Bike Share Pittsburgh Inc.

This Privacy Policy provides information on how we collect, store, use, and disclose Personal Information provided to us in the course of participating in Bike Share Pittsburgh (“POGOH”) and / or the POGOH membership application process, and during the time that you are a POGOH customer and member. Our Privacy Policy complies with all applicable federal, state, and local laws.

By reviewing this Privacy Policy, and by accepting the Terms and Conditions of the POGOH registration, you expressly consent to the collection, use and disclosure of your Personal Information for the purposes, and in the manner set out, in this Privacy Policy. By accessing or using any of our Services, you accept, without limitation or qualification, the terms of this Privacy Policy.

Your knowledge and consent are required for the collection, use or disclosure of your Personal Information, except as required or permitted by applicable law. You may withdraw your consent to the collection, use and disclosure of your Personal Information by contacting Bike Share Pittsburgh Inc. using contact information provided below. Withdrawing your consent may affect your ability to use our services and may result in, or require, POGOH account termination. You may not withdraw your consent in an effort to avoid the execution of a legal obligation, including to a credit reporting agency, or a request from a legally enforceable government agency.

This Privacy Policy and our legal obligations are subject to the laws of the Commonwealth of Pennsylvania and the United States, regardless of the location of any user.

Personal Information We May Collect

Personal Information is defined in this Privacy Policy as:

  • information that establishes your identity (for example, your name, address, phone number, date of birth, etc.), but does not include aggregate data from which we have removed personal identifiers or your business contact information;
  • information related to your use of the POGOH Program including POGOH ridership history with start and end times and locations of your POGOH trips;
  • information that you provide on your registration for POGOH membership or in registering your POGOH account, including information required to confirm and/or establish your eligibility for corporate and community memberships; and
  • your financial information (such as credit account card numbers) and information about your financial behavior (such as your payment history),

(collectively, your “Personal Information”).

How We use Your Personal Information

We may collect and confirm your Personal Information as part of your registration for POGOH membership and throughout the term of your POGOH membership.

We collect and use Personal Information to:

  • operate the POGOH system;
  • to support, personalize, and optimize your use of, and experience with, our bike share services; and 
  • to communicate with you regarding our services and products;
  • to verify your identity or complete a payment transaction that is authorized by you;
  • to provide special memberships and discounts, including community and corporate memberships;
  • to communicate to you any benefit, feature, service or other information about your POGOH membership and the POGOH program;
  • to promote POGOH related products or services, as well as products or services of sponsors and partners which may be of interest to you;
  • to accurately show you POGOH bikes near your location, and accurately record your trip information;
  • to send, deliver or display advertising to you via digital channels (including on-line and email); and
  • as otherwise required or permitted by law.

How We Share Your Personal Information

In order to operate the POGOH system, we may make your Personal Information available to specific employees, affiliates, agents, service providers, and insurers who are required to maintain the confidentiality of your Personal Information. 


We may disclose your Personal Information for the following purposes:

  • to verify or process your credit or debit card payments in the context of transactions that have been authorized by you;
  • to prevent fraud, such as disclosure to credit reporting fraud checking agencies;
  • to administer insurance claims; and
  • to comply with government agencies, public bodies, or other entities who have a right to issue requests in the event of an enforceable legal requirement to do so.  

Third Party Service Providers

We use trusted third-party service providers, Lyft Urban Solutions, Authorize.net, and Zendesk (the “Third-Party Service Providers”), to help us operate key aspects of the POGOH system, including administration, payment processing, and customer support. These providers process your Personal Information on our behalf and in accordance with this Privacy Policy.  ​​

  • Software and Backend Administration – Lyft Urban Solutions
    We use Lyft Urban Solutions, a bikeshare vendor and supplier, to manage and administer the trips on the POGOH system. Any Personal Information you provide in the registration process, and in the ongoing use of the POGOH system, may be stored and processed outside of the United States, in coordination with Lyft Urban Solutions.

  • Payment Processing – Authorize.net
    We use Authorize.net, a third-party payment company, to securely process credit and debit card transactions. Authorize.net may collect Personal Information from you in connection with a payment, including your card data, and may store and process this information on servers located outside of the United States.
    Authorize.net may also provide us with limited information—such as your name, card type, expiration date, and the last four digits of your card number—which we use solely for the purpose of facilitating payments or managing ongoing membership plans that require recurring billing.

  • Customer Support – Zendesk
    We use Zendesk, a third-party customer service platform, to manage and respond to member inquiries and support requests. Any Personal Information you provide in a support ticket, email, web form, live chat, or any other form of support inquiry may be stored and processed outside of the United States, in any jurisdiction where Zendesk or its affiliates operate.

This Privacy Policy does not address the practices of third party service providers. You may visit other websites or apps, through links on the Services, which may collect, use and share your personal information in accordance with their own privacy policies. The information practices of those linked websites or apps are not covered by this Privacy Policy, and we encourage you to be very cautious before you disclose your personal information to others. We are not responsible or liable for how those companies use any personal information. We make no representation or warranty about the privacy or security policies of these third party companies.

Limiting Use, Disclosure and Retention

We do not use or disclose your Personal Information for any purpose other than the purpose for which it was collected, except with your consent, or as required or permitted by applicable law. We retain your Personal Information only as long as necessary to fulfill the purposes for which it was to be used and disclosed. We do not retain or share geolocation data.

Accuracy/Correction of Personal Information

We keep your Personal Information as accurate, complete, and up-to-date as is necessary and reasonably practical for the purposes for which it is to be used. It is your responsibility to inform us of any changes to your Personal Information that occur during the course of your membership. You may update your Personal Information using our website or mobile applications at any time.


Security and Safeguarding your Personal Information

We protect your Personal Information by using safeguards that are appropriate to the sensitivity of the particular information. We use comprehensive security controls to protect your Personal Information against unauthorized access, use, alteration, duplication, destruction, or disclosure. 

On our website we have installed encryption software conforming to the Secure Socket Layers (SSL) protocol to safeguard the information you send to us. It is important for you to protect against unauthorized access to your password and to your computer. If your POGOH account password is compromised, notify Customer Service at once at hello@pogoh.com


Collection Through Our Website

When you visit the POGOH website, whether or not you are a member, we will collect your internet protocol (IP) address. We also use cookies to identify you as a return visitor and allow you to personalize our website to reflect your preferences and to store Personal Information that you have voluntarily provided through the website. We may also collect information such as the web browser used to access our website, and other information on a consolidated basis for statistical and survey purposes. 


Communication

We may communicate with you in various ways, including by telephone, email, your POGOH member account, physical mail, using the contact information you have provided. If we are communicating with you by phone, we may record calls for quality assurance.

Limitation of Liability 

YOU UNDERSTAND AND AGREE THAT ANY DISPUTE OVER PRIVACY IS SUBJECT TO THE TERMS OF THIS PRIVACY POLICY AND THE TERMS OF USE FOR ANY OF OUR SERVICES, INCLUDING, BUT NOT LIMITED TO, LIMITATIONS ON DAMAGES AND MANDATORY MEDIATION OF DISPUTES.  YOU AGREE THAT OUR LIABILITY FOR ANY BREACH OF THIS PRIVACY POLICY IS LIMITED TO THE SUM OF $100, BUT ONLY TO THE EXTENT THAT SUCH CLAIM IS NOT OTHERWISE BARRED BY THE TERMS AND CONDITIONS OF USE.  SOME JURISDICTIONS DO NOT ALLOW FOR LIMITED LIABILITY OR EXCLUSION OF IMPLIED WARRANTIES.  IF THESE LAWS APPLY TO YOU, THEN SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MIGHT NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.
